And the standard for upholding the agency’s action is NOT that it was a good idea, but rather that the agency acted in a rational way to further the goals Congress gave it discretion to further. That’s a pretty low standard to meet, as even a pretty stupid decision can be characterised as “rational” when you explain why it seemed like a good idea at the time.
They did not consider whether the first amendment protects the word, because they don’t like to issue rulings on things that the lower courts did not consider. And the lower courts did not address whether the First Amendment might protect the station.
