Well, it's a matter of semantics I think... My problem is, when it's true it's embodied in Section 107 of the U.S. Copyright Act (source

here), there are no explicit, predefined, legal specifications of how much and when one can copy, but there are guidelines for fair use, meaning each case of copying must be evaluated individually. I have trouble with calling a "law" something that you can both do AND be sued, without knowing if you honestly did wrong or not.
EDT: and the fact that the "fair use" concept varies from country to country, and has different names (such as "fair dealing" in Canada) and other limitations outside the USA... while the copyright laws are international laws! In another words, what is considered "fair use" in the USA may not be the same in Japan!
